ROC was the legal government of China when they took over the Government from the Qing Emperor. This Government was overtaken by the CCP in 1949. In the ROC's constitution, which is also the Taiwanese Government's constitution today, ROC believes they are still the ruler of China and would one day retake China from the CCP.
Although Taiwanese lawmakers made several attempts in the past to amend the ROC's constitutions, particular on the part that wanted to become an independent state, they failed.
