But then again, if it is mandatory, then no lawyer will willing to take up a difficult case
But if not mandatory, also don't guarantee lawyers will take up a difficult case if asked to enter into such an arrangement

The underlying issue is the high cost of litigation.
Besides lawyers' fees, court filings fees are also very expensive.
Justice is no longer cheap or accessible for the poor.
Many innocent end up penalised.
