Sacking Unvaccinated Staff Isn’t Wrongful If WFH Option Is Not Possible , MOM Advises
#1

By Jeremy Lee -25 Oct 2021, 10:58 pm

......

last weekend, unvaccinated people were told that they won’t even be allowed at their workplaces from 1 Jan.

Turns out their rice bowls will be affected even more. The Ministry of Manpower (MOM) has advised employers that if they sack unvaccinated staff, it won’t be considered wrongful dismissal.

......

these employees should be those who can’t work from home (WFH), and thus  unable to do the jobs they’re supposed to do at their workplaces due to their status.

......

employers are advised to make some concessions for employees certified as medically ineligible to take the vaccines.

They should consider the following options:

1. allow them to WFH if possible, and don’t let this affect their performance appraisals
2. transfer them to positions where they can WFH if available, with commensurate pay
3. exempt them from vaccination requirements if they’re really needed at the workplace

If they sack F Tr earning less than $12k per mth as mid- professionals, then I am OK. Some kind of housekeeping must be done.

But I am sure, CECA HR will use it to sack locals instead.

This system will be abused.

Why do we need 5 Mayors and 80 PAP Ministers?

This is violation of human rights, however this is being executed. If the individual health does not permit them to get vaccinated.

How will the ministry help them? Will the state take cares of their well-being?

We are not a welfare state, our government who are highly paid could only resort to simple executions. They do not deserve the remunerations that they so justify.

Tan SL is not competent enough and cannot handle workplace matters.

90% of the time, the employees CANNOT be re-deployed ie from Finance to IT, from Commercial Ops to HR, or from Engineering to Warehouse due to same old 2 reasons why JoTeo always fail in her job.

1. Skills Fit

2. Salary fit ie Engineer paid $8k can transfer to Warehouse Officer at $3k?

10% of the time it can be done because the company is big enough ie Tan Tock Seng Hospital, Google . . .etc

There is a simple way to solve this 90% problem they created. Must I teach Tan SL?

When Gov speaks loud and clear, majority will take the advantages just like the FT overtaking local jobs. Nothing changes when man are full of wickedness.

For unvaccinated employees whose work can be performed at home, employers may allow them to continue to work from home but such working arrangements remain the employers’ prerogative3. As the vast majority of vaccinated employees eventually return to the workplace more frequently, the prolonged absence of the unvaccinated employees from the workplace may affect their individual performance as well as negatively impact team or organisational performance.

For employees whose work cannot be performed from home, employers can:

  1. Allow them to continue in the existing job with PET done at employees’ own expense and own time (i.e. outside of working hours); or
  2. Redeploy them to suitable jobs which can be done from home if such jobs are available, with remuneration commensurate with the responsibilities of the alternative jobs; or
  3. Place them on no-pay leave or, as a last resort, terminate their employment (with notice) in accordance with the employment contract. If termination of employment is due to employees’ inability to be at the workplace to perform their contracted work, such termination of employment would not be considered as wrongful dismissal.

Most Singaporeans will never vote for oppositions, so stop dreaming that oppositions will gain any traction’s over the next 10-15 years.

Financial crisis of Lehman brothers that brought a challenge with our economy, or town councils that made loses with the fundings they collected, or that the MRT system that need major maintenance due to the lack of it for 10 years, or that the escape of Mas Salemat, etc. major issues such as these did not move the people from voting oppositions.

While would such cases of employees well being where MOH is supporting the employers will move the needle. Stop dreaming. The lack of accountability and/or responsibility with our current administration is never in the mind of our people.

The lack of jobs and the fear of investors that create the jobs are most people’s fear, with the lack of incomes are in most of the people’s mind here. Until such times that the incomes are affected so much so that then people will look into the accountability and responsibility of our administration. Because right now this has yet to hurt many people still. Just my opinion.

Dont say it too early?
Nobody can predict the future.
Nobody expected Trump could be a president if Hillary Clinton secret did not show to the public.

But I know Sg has already rotten.
In Chinese, we call it 沉沦。

Well, in the past many has said what you have claimed. “Don’t say it too early”, the ruling party ended up with “resounding mandate” and Kenneth Rajaratnam says “Singaporeans have made your choice, stop complaining”

And those were the times that many says the ground is good for the oppositions…. We cannot compare with America’s election. Their people has the choice and they have “no fear” or their democratic consciousness is much better than us. Just my opinion.

2025 is the yr. when New world order won.
We have only only LAWs to go by.
We can't expect our Ministry to take the rap
We have the Act of God and Princes
We have the Nuremburg codes guilty by hanging.
Employers are on their own. They exist only to make money.
Following orders are not excuses to be exempted under the Codes.

They follow the west.
America has already enforce mandatory vaccine for public and companies with large work force.
But vaccination rate did not improve.

Another phenomena happening these few months is a great resignation, many rather quit and wait for better working hours and pay jobs.
