The bus driver had failed to check before she move on. She may get suspended or fired for failing to check the safety of the kid before closing the door.
The guy standing next to her is causing the distraction by chatting with her and also he pose a safety violation for not sitting down. This driver I think under the US law confirmed to get fired.
