Yes, it is important to have both a will and a Lasting Power of Attorney (LPA) in your estate planning. Let me explain why:
- Will:
- A will is a legal document that outlines your last wishes regarding your assets and loved ones after you pass away.
- It typically includes details such as:
- Your assets and liabilities (including debts).
- Beneficiaries (who will receive your assets and how much each beneficiary will get).
- Guardians for your children until they turn 21 years old.
- Executors who will carry out the instructions in your will.
- If you do not make a will, your assets will be distributed according to the Intestate Succession Act (ISA), which may not align with your specific wishes.
- Writing a will is essential, especially if you have family members who are financially dependent on you.
- Lasting Power of Attorney (LPA):
- An LPA allows you (the donor) to appoint one or more persons (known as the donee) to manage your affairs and make decisions on your behalf if you lose mental capacity.
- The donee can have general powers related to personal welfare (such as where you live) and property/financial affairs (such as managing your business).
- Without an LPA, no one will have the right to make decisions on your behalf if you lose mental capacity. Court processes can be lengthy and expensive, and the court may not appoint a deputy of your choice.
- Making an LPA while you still can ensures that your interests are protected when you become vulnerable.
- Why You Need Both:
- A will takes effect after your death, whereas an LPA takes effect when you lose mental capacity.
- Having both ensures a more complete estate plan:
- The will addresses post-death distribution of assets.
- The LPA ensures someone can act on your behalf during your lifetime if needed.
In summary, having both a will and an LPA is crucial for comprehensive estate planning123.
Agree bro, both are important and they serve different aims and objectives

After “surviving” the Taiwan earthquake he plans to write a will in case he gets dementia in future.
Someone tell this uneducated ah beng that a will is meant for other peepur AFTER your are dead.
If you are alive and have dementia, an LPA is the instrument that will help protect you, leaving you in the good hands of peepur you trust
Shows here again that being properly helicated is really important
To be fair to the ah beng, he is not wrong in saying he needs to draft a will before he gets dementia. You should write your will while you are still lucid and objective. Of course best to get your lpa done as well but there are also ways to get around it.

Someone also needs to inform Mark Lee that if a big rock falls on him during an earthquake, he either gets a broken head or a squashed head, not dementia.

It can also be construed that he thinks he needs to write a will first so that in case he gets dementia he will be well looked after
Normal folks like us know that the LPA is the actual instrument for such occurrences instead
