JUNE 9 — G25 welcomes appointment of Latheefa Beebi Koya, as Malaysia’s new Chief Commissioner of the Malaysian Anti-Corruption Commission (MACC). On the advice of by the then PM Tun Mahathir Mohamad. 

His Majesty the Yang di PertuanAgong made the appointment. She succeeds Datuk Seri Mohd Shukri Abdull, who resigned a year before his two-year contract was due to end in 2020. G25 is confident that the controversial appointment of prominent human rights lawyer will prove to be an asset for all citizens of Malaysia. 

Even though the appointment is seen as a unilateral move on the part of the then Prime Minister, the post needed to be filled immediately. While we uphold the democratic process of checks balances through the process of a Parliamentary Select Committee, this appointment should be seen as an exceptional circumstance. Corruption in our nation has reached critical proportions, traversing all levels of society. Whilst we had wished for the emergence of the constitutional convention of parliamentary scrutiny in the appointment process, which sadly, did not happen, it cannot be denied that the appointment was strictly in accordance with the law.

The Pakatan Harapan (PH) govt came to power against the background of a much-needed overhaul of financial, legal and political transgressions that have affected a vast majority of grassroots Malaysia. Counter-productive criticisms of Latheefa Koya’s appointment are self-serving, manipulative and politically-motivated. Detractors are exploiting the on-going narrative of PH’s failed promises for their selfish, political advantage. On contrary.

Malaysians have to envision a bigger picture. Counter-productive criticisms of Latheefa Koya’s appointment are self-serving, manipulative and politically-motivated. Detractors are exploiting the on-going narrative of PH’s failed promises for their selfish, political advantage. On the contrary, Malaysians have to envision the bigger picture.  Corruption,  cronyism and nepotism must be tackled by a commission that is professional. It must be steered by a morally-upright and experienced individual at the helm, who will fearlessly, but fairly, enforce the rule of law, above everything else. These qualities are embodied in Latheefa Koya. We should judge her by her deeds as Chief Commissioner of the MACC, irrespective of her previous political inclinations.

G25 acknowledges that the process of her appointment was unconventional. Having said that, it is necessary to seek a formal change in the law in order to impose the rigour of parliamentary scrutiny. However, till then, the flexibility in adhering to constitutional conventions should not be denied. 

Here!. Also, PH is still undergoing a transitional period whereby there are often unrealistic expectations of Tun Mahathir and his Cabinet. Rather, we must support decisions that promote good governance and appropriate legal processes. After all, these are a means to an end.

PUTRAJAYA, July 11 — The govt respects views of all parties regarding the addendum issue, but emphasises that document is subject to judicial process, said Prime Minister Datuk Seri Anwar Ibrahim.

This additional document is a court matter now, no issue. Let the court handle it. Everyone is entitled to their opinion; we respect that, but (we) must follow due process,” he told reporters after performing Friday prayers at Surau Ar-Rahim here today.

Anwar was responding to Umno’s statement urging for implementation of the house arrest order for former Prime Minister Datuk Seri Najib Tun Razak, in line with the absolute powers of the Yang di-Pertuan Agong under Article 42(1) of the Federal Constitution.

Umno secretary-general Datuk Dr Asyraf Wajdi Dusuki reported saying, followed confirmation of additional document’s existence by the Attorney General.

Last Wednesday, media reported that the Attorney General’s Chambers (AGC) did not dispute existence of the additional document, which would allow Najib to serve the remainder of his jail term under house arrest. However, the AGC contested the procedure for submitting the document as new evidence in Najib’s judicial review application at the High Court. — Bernama news

Sultan Sharafuddin Idris Shah added that he supported the statement by the Istana Negara (National Palace) on Jul 10 regarding power of the king to appoint these top judges on advice of the prime minister after consultation with the Conference of Rulers. “The process provided for under Federal Constitution must be carried out transparently and carefully, in order to uphold rule of law support the principles of justice form the core of governance in this country,” the Sultan of Selangor said. “In this connection, all parties are urged to refrain from making any speculation or unfounded accusations without complete and verified facts.”

However, there has been no formal announcement of any top judges’ appointments as widely expected even though the Conference of Rulers had finished their 3-day meeting at mid-day on Thursday. This unusual development has provided yet another twist to a deepening political crisis raging over allegations of political intervention in the appointment of senior judges following the retirement of Chief Justice Tengku Maimun Tuan Mat and President of the Court of Appeal Abang Iskandar Abang Ismail earlier this month...
