I think this is the point where everyone scratch their head 
because the US side has not made any statement on his behalf likely because they see him as a pro ccp citizen.

Most analyst feel he is unlikely to be a US spy. The real spy called  Sandy when caught by CCP, Obama took great pains to arrange a spy swap to free her..Her sentence was only 3.5yrs. This guy is life sentence.
A good spy who spied for US of course will pretend to be pro-CCP. This will put the guards down by the CCP counter-intelligence. If he has been showing to be anti-CCP, how can he possibly do his spying work when the agents of CCP counter-intelligence dept would be watching him like a hawk? I would say he is a good spy but the CCP counter-intelligence are smarter. 
It is unlikely for the Biden administration to do anything at the moment with the high animosity between China and US due to constant harassment of China by the US. Further, he is of Chinese skin colour which the Americans treat as second class.  Rolleyes
