So if say rob and kidnap but no one killed no need death sentence is that your definition? Only when got ppl die then death sentence is needed? How about car driver bang dead pedestrian this kind got kill ppl so should have death sentence going by your definition?

no, it is base on intention, 
rage or evil thoughts, plan or is a response, lives under threat etc 
many conditions to think about
if conditions meet then death sentence is an option.
