The black Saab driver is at fault.  That the  Merc did not give way is not itself a criminal act.  Sure, he has poor road manners but he did not break the law in not giving way. 

The black Saab driver since he cannot overtake, should have slowed down instead of going crazy and sideswiping the Merc and beating the red light.

Tiagong a lot of edmwers blame the Merc and a motorcyclist instead of laying the actual blame on the Saab driver.
